22 March 2016, Donetsk municipal court of Rostov region sentenced the Ukrainian pilot Nadezhda Savchenko to 22 years of imprisonment in a colony with a strict regime. This case caused wide outcry in Ukraine; in this concern the reaction of Kiev authorities by way of protest on court’s decision was rather expected.
The Ukrainian MFA in its statement concerning Savchenko`s sentence not only blamed Russia in deviation from basic norms and principles of international law, but disrupting of the Minsk Agreements
In this regard the Ministry of Foreign Affairs of the Donetsk People`s Republic finds it necessary to state the following:
Donetsk municipal court of Rostov region stated to drop criminal charges concerning Savchenko on accusation in unlawful acts against civilians in Luhansk region as «this case is outside the jurisdiction of the Russian Court». As the Russian court is not able to sentence a foreign citizen for assassination attempt against foreign citizen committed beyond the Russian Federation the court considered crimes of Savchenko only against the citizens of the Russian Federation. Another time it proves Russia’s been following all international legal norms.
We also turn Kiev’s attention to the fact the Russian Federation is not a side of a conflict according to the Minsk Agreements and doesn’t take part in prisoners’ exchanges. From our point of view, Mr. Savchenko could be sentenced to more years. In this connection the Ministry of Foreign Affairs of the Donetsk People`s Republic would like to remind Kiev of Protocol Additional II to the Geneva Conventions from August 12, 1949 concerning victims of war` defense of non-international character. According to this document, war crimes committed by Ms. Savchenko are not subjects of amnesty.
